Testifying With Confidence: Why Courtroom Skills Matter

I still remember the first time I had to testify in court.

All eyes were on me. The judge, the attorneys, and even the public were paying close attention. And while I knew my case, I could feel the panic rise. My voice trembled. I stumbled over my own photos. I second-guessed my answers.

At that moment, I realized something critical:

We don't just show up with evidence, but also clarity, confidence and credibility.

Knowing the facts isn’t enough; you also need to know how to deliver them.

The Fear Is Real

Many professionals—especially in code enforcement, municipal inspections, and regulatory fields—are thrust into courtroom environments with little to no formal training in how to testify. You're expected to:

  • Present evidence clearly,

  • Connect your findings to the code,

  • Remain composed under pressure,

  • And avoid giving opposing counsel anything to work with.

The problem? Most of us aren’t taught how to do this well.

And that lack of preparation can lead to a freeze moment … that awful mental blank when you're on the stand, and suddenly nothing feels clear anymore.

It’s terrifying because you know that any misstep, any poor phrasing, or any sign of uncertainty could be used to undermine your case.

But here's the good news: there’s a better way.

All Aboard the “Yes Train”

In my courtroom training, I teach the concept called the “Yes Train.”

It’s a strategy that helps you build trust and credibility through structured, confident testimony. When you present your information clearly and walk the judge or hearing officer through your thought process step by step, they begin nodding along—literally or mentally.

Each yes they think internally is a win for you.

  • Yes, that makes sense.

  • Yes, that supports the evidence.

  • Yes, the inspector followed protocol.

  • Yes, I can connect the violation to the documentation.

That’s momentum. And in the courtroom, momentum matters.

But What Happens When You Freeze?

If you’ve ever experienced that panic on the stand, here’s what I want you to know:

🟢 It’s okay to pause.
Taking a breath or collecting your thoughts doesn’t make you look unsure—it makes you look thoughtful.

🟢 Ask for clarification.
If a question is unclear, it’s perfectly acceptable to ask for it to be repeated. This gives you time to prepare a solid answer and helps avoid misinterpretation.

🟢 Return to your evidence.
Center your answers around what you can prove. Don’t guess. Use your documentation, photos, and field notes to stay grounded.

These aren’t stall tactics. They’re best practices.

When done correctly, they demonstrate professionalism, not panic.

The Cost of Poor Testimony
